Neighbour dispute against nude gardener dismissed


Cheltenham magistrates have dismissed a case brought against a naturist by his neighbour, saying there was no case to answer.

Theresa Fairchild had only been living in her new apartment for a month when she looked out from her balcony in January and saw her neighbour Donald Sprigg, aged 63, gardening completely naked. In March she saw him again gardening in the nude, though this time he was wearing gloves. Ms Fairchild claimed in court that Mr Sprigg had performed indecent acts while gardening in the nude and had harassed her through insulting behaviour. Mr Sprigg strongly denied the claims though did tell magistrates that he had been a naturist for 30 years, and had been at his property for 20 years without any complaints from neighbours.

The magistrates found that the evidence produced against Mr Sprigg was "vague and weak" and threw out all charges. Mr Sprigg has expressed his delight at the decision but has vowed that he will no longer garden in the nude.
