Proposed right to child access for divorced parents

Government ministers are currently drafting new rules which would give divorced parents an automatic right to have contact with their children after their divorce.

If adopted, the rules would mean that the courts would be under a legal duty to make provision for child access during divorce proceedings, any parents who do not comply with the mandatory child contact orders would be found in contempt of court with risks of fines, and in serious cases, prison.

Children's minister, Tim Loughton, said the goal was that "a child will have a relationship with both his or her parents, regardless of their relationship with each other". He added that evidence suggests children benefit from a relationship with both parents, and that society now "recognises the valuable distinct role of both parents".

Campaign director for Fathers4Justice, Nadine O'Connor, showed cautious optimism, saying "I will believe it when I see it", but said it would be "a massive step forward" if the change was implemented, and would send a message that "dads have as many rights as mums".
